This California Privacy Notice (“Notice”) applies to the collection and use of California residents’ “personal data” by EnterpriseDB Corporation (“EDB”, “we”, “us”) who (i) register to use the EDB DBaaS Cloud Offering DBaaS and services which we market for subscription available at (the “DBaaS Service”); (ii) access and use our website, including EDB’s Migration Portal and Support Portal (www.enterprisedb.com) (the “Website”); (iii) attend our live and virtual events and conferences (“Events”); (iv) participate in our surveys, contests, and sweepstakes (together, the “Services”); or otherwise interact with us. 

As used in this Notice, “personal data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.  It does not include de-identified or aggregate information, or public information lawfully available from governmental records.

This Notice supplements our Privacy Policy and Terms of Use and provides information that is required by various California data privacy laws.  In the unlikely event there is a conflict or discrepancy between this Notice and our Privacy Policy, the provisions of this Notice shall apply to our activities regarding California residents’ personal data.

California Consumer Privacy Act 

The California Consumer Privacy Act (CCPA) gives California residents the right to know about the categories of personal data we collect about them and provides them with certain rights with respect to their personal data, as we describe below. 

Please note that the information in the CCPA section of this Notice does not include or apply to  personal data that is not subject to CCPA, specifically (a) personal data we collect about employees, job applicants, and independent contractors (“Employment Data”) and (b) personal data we collect about individuals when acting in their capacity as representatives of entities with which we are doing business or engaged in due diligence activities (“B2B Data”). 

 

Personal Data We Collect and Have Collected in the Past 12 Months – Sources and Categories

In the 12 months preceding the date of this Notice, we may have collected personal data when you utilized or interacted with our Services, or when you voluntarily provided information to us through our web portal, email or phone number.  We will continue to collect personal data from the same sources. 

The categories of personal data we may have collected from these sources during the 12 months preceding the date of this Notice , and will continue to collect, include the following: 

  • Personal identifiers: Name, email address, phone number, email address, and username and password, your company name, IP address or other unique identifier, your social media account(s) name, user name or handle, and public profile.
  • Commercial information:  Records of products or services considered, consuming histories or tendencies.
  • Internet or other electronic activity information: Device operating system type and version, browser type and language, EnterpriseDB cookie information, file information, time stamped logs regarding access times and duration of visits, the websites you visited before coming to the Website, and other usage data relating to your activities on the Website, including the pages you request. 
  • Educational information: Information about your educational history, degrees and credentials. 
  • Professional information: Name of your employer and your professional title, relevant certifications you may hold. 
  • Inferences drawn from any of the personal data identified above.

 

Purposes for Collection of Personal Data 

We use your personal data to provide you with information you request and information about our products and services, when you interact with us at Events, for advertising and marketing purposes including to send you promotional communications, to understand the  use of our Website, to operate, monitor and improve our Website, for internal business analysis, to prevent fraud and activities that are illegal or violate our Terms of Use, and to protect our rights and the rights and safety of our users or others.

Additional Information About How We May Share Personal Data

We may also share your personal data as required or permitted by law to comply with a subpoena or similar legal process or government request, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our rights and property or the rights, property or safety of others, including to law enforcement agencies, and judicial and regulatory authorities. We may also share your personal data with third parties to help detect and protect against fraud or data security vulnerabilities.  And we may transfer your personal data to a third party in the event of a sale, merger, reorganization of our entity or other restructuring. 

 

Personal Data We Sold to Third Parties in the Preceding 12 Months

In the 12 months prior to the date of this Notice, we sold personal data to third party digital advertising networks by allowing such third parties to place cookies or other trackers on our Website.  The data they collected may be used to provide you with personalized content and present you with third party products or services in which you may be interested.  

Under California law, you have the right to direct us to opt out of the sale of your personal data.  To do so, please update your Cookie Preferences to indicate ‘No’ on allowing ‘Advertising Cookies’ and ‘Functional Cookies’ or by contacting us at 781-357-3390.

 

Personal Data of Minors

Our Services are not directed to minors under the age of 16.  We do not knowingly collect or sell the personal data of minors under the age of 16.    

 

How We Secure Your Personal Data

We have put in place reasonable and appropriate administrative, technical and physical procedures to protect personal data we collect. However, no company, including EnterpriseDB, can fully eliminate security risks associated with personal data. To help protect yourself, please use a strong password, do not use the same passwords to access your EnterpriseDB accounts that you use with other accounts or services, and protect your usernames and passwords to help prevent others from accessing your accounts and services.

 

California Privacy Rights Under CCPA

 

Right To Request Disclosure of Data We Collect and Share About You

If you are a California resident, you have the right to ask us for any or all of following types of information regarding the personal data we have collected about you in the 12 months prior to our receipt of your request:

  • Specific pieces of personal data we have collected about you; 
  • Categories of personal data we have collected about you; 
  • Categories of sources from which such personal data was collected; 
  • Categories of personal data we sold or disclosed for a business purpose about you; and 
  • The business or commercial purpose for collecting or selling your personal data.
     

 

Your Right To Request Deletion of Personal Data We Have Collected About You

Upon your request, we will delete the personal data we have collected about you, except for situations where the CCPA authorizes us to retain specific information, including when itis necessary for us to provide you with a good or service that you requested; perform a contract we entered into with you; maintain the functionality or security of our systems; or comply with or exercise rights provided by the law.  The law also permits us to retain specific information for our exclusively internal use, but only in ways that are compatible with the context in which you provided the information to us or that are reasonably aligned with your expectations based on your relationship with us.  We will act on your deletion request within the timeframes set forth below.

Our Sale of Personal Data 

Under the CCPA’s broad definition of the term “sale,” we sell personal data by allowing third parties that facilitate digital advertising to place cookies and other trackers that collect information about your browsing and interactions with other websites.  That data may be used to provide you with marketing information about products or services in which you may be interested.  

We do not knowingly collect or sell the personal data of minors under the age of 16.    

 

Opting Out of the Sale of Personal Data

You can direct us not to sell your personal data by updating your Cookie Preferences to indicate ‘No’ on allowing ‘Advertising Cookies’ and ‘Functional Cookies’ or by contacting us at 781-357-3390.

 

Exercising Your Rights and How We Will Respond

To exercise any of the rights above, or to ask a question, contact us at privacy@enterprisedb.com, 781-357-3390, or use the contact details set out at the end of this Notice.

For requests for access or deletion, we will first acknowledge receipt of your request within 10 business days of receipt of your request.  We provide a substantive response to your request as soon as we can, generally within 45 days from when we receive your request, although we may be allowed to take longer to process your request under certain circumstances.  If we expect your request is going to take us longer than normal to fulfill, we will let you know.

For requests to stop the sale of your personal data, we will comply no later than 15 business days after receipt of your request.

We usually act on requests and provide information free of charge, but we may charge a reasonable fee to cover our administrative costs of providing the information in certain situations.  In some cases, the law may allow us to refuse to act on certain requests.  When this is the case, we will endeavor to provide you with an explanation as to why.  

 

Our Commitment to Honoring Your Rights

If you exercise any of the rights explained in this Notice , we will continue to treat you fairly. You will not be denied or charged different prices or rates or provided a different level or quality of our Services than others.

 

Verification of Identity – Access or Deletion Requests

We will ask you for identifying information and attempt to match it to information that we maintain about you.  

If we are unable to verify your identity with the degree of certainty required, we will not be able to respond to your request.  We will notify you to explain the basis of the denial.  

 

Authorized Agents

You may designate an agent to submit requests on your behalf.  The agent must be a natural person or a business entity that is registered with the California Secretary of State.   

If you would like to designate an agent to act on your behalf, you and the agent will be required to provide us with proof of the agent’s identity and proof that you gave the agent signed permission to submit a request on your behalf.  Additionally, you will be required to verify your identity by providing us with certain personal data as described above or provide us with written confirmation that you have authorized the agent to act on your behalf. 

Please note that this subsection does not apply when an agent is authorized to act on your behalf pursuant to a valid power of attorney.  Any such requests will be processed in accordance with California law pertaining to powers of attorney.   

 

Requests for Household Information

In some instances, personal data can be associated with a household (a group of people living together in a single dwelling) and CCPA provides rights to access or delete such “household” data.  We do not collect personal data at the household level.

 

California Shine the Light

California Civil Code Section 1798.83, also known as the “Shine the Light” law, permits California residents to annually request, free of charge, information about certain categories of personal data a business has disclosed to third parties for direct marketing purposes in the preceding calendar year. California Do Not Track  

Some browsers have a “do not track” feature that lets you tell websites that you do not want to have your online activities tracked.  At this time, our Website does not respond to browsers’ do not track signals.
