Event Terms and Conditions
INTRODUCTION
EnterpriseDB Corporation (hereinafter “EDB”) has scheduled this Event and by registering for the Event you (“You”, “Your” or “Attendee” as referred to herein) are agreeing to comply with the terms and conditions set forth herein below (hereinafter the “Terms”) and that the Terms govern Your attendance at the Event.
PERSONAL DATA, PHOTOGRAPHY, AND VIDEOGRAPHY
Personal information may be collected in order to process Your Event registration, such as Your contact information, identification numbers, and credit card information. Please be aware that EDB may employ electronic monitoring with our attendees during Event via badge scanning. The information would enable us to review traffic patterns for a better attendee experience as well as improve the education of the event by understanding attendance of attendee types.
You consent to receiving the post event survey for voluntary feedback about your experience at the Event.
You also acknowledge and accept that there will be a variety of photography and videography captured throughout all venues, events and activities at the Event, and Your image may be captured via photography or videography, either individually or in a group setting at the Event. You hereby grant to EDB, its legal representatives and assigns, and those acting with its authority and permission, the irrevocable and unrestricted right and permission to record and/or capture Your image and voice for use, broadcast and distribution of this material during and after the Event via print, projection, broadcast, internet websites, or other media in relation to the Event and EDB. You hereby waive the right to inspect or approve the finished product or products. You hereby release and discharge EDB and its authorized agents from any and all claims, including without limitation any and all claims for libel and invasion of privacy. You also agree that You attend the Event at Your own risk and that EDB’s liability for any and all actions arising out of or in any way related to the Events is limited to a refund of Your registration fees.
All personal data shall be processed in accordance with EDB’s Privacy Policy.
EDB does not authorize individual Attendees to film or record talks and presentations made at the Event or otherwise record any sound, voices, images or photographs of keynotes and presentations. Further, all Attendees shall comply with applicable Data Privacy laws.
PRODUCT/SERVICE DISCLAIMER
The presentations and associated materials offered during the Event may reflect the direction that EDB may take with respect to certain product development plans all of which are subject to change by EDB in its sole and absolute discretion, with or without notice to You. Many factors can materially affect EDB's product development plans and the timing of future product releases. Accordingly, You hereby acknowledge and agree that: (i) EDB is not committing to develop or deliver any specified products, upgrades, enhancements or any other product features or functions that You become aware of in connection with the Event and (ii) any information provided or made available to You or of which You otherwise become aware through your participation in the Event is provided or made available to You solely for informational purposes and should not be relied on by You or anyone else in making any decisions.
Sessions reflect the speakers’ own views and opinions, not necessarily those of EDB.
PROTECTION OF MATERIALS
EDB and Event Speakers retains all right, title and interest in any and all information and materials provided in any form whatsoever in connection with the Event, including, without limitation, course and training materials, product demonstrations, assessments, software, tools, product specifications and documentation, flow charts, file formats, technical drawings, and any and all information and materials regarding products, techniques and processes (collectively, the “Presentation Materials”) and all derivative works thereof.
If we provide access to any software as part of the Event, then such access is governed by the applicable terms of the software.
The Presentation Materials may contain information proprietary to EDB or Event Speakers. Unauthorized distribution (via sales, copying, posting on intranet/internet) is expressly forbidden.
ATTENDEES
Those eligible to register and attend the Event include EDB customers, EDB partners, EDB contracted consultants, EDB employees and any other individuals who have received a specific invitation or written approval from an EDB representative to attend the Event. If EDB deems a registrant ineligible, EDB reserves the right to cancel the registration and issue a refund. Attendees must be 21 years of age to attend the Event. Attendee participation in certain event activities may be restricted to comply with applicable laws and regulations. Those outside of these parameters must have prior written approval from EDB. EDB reserves the right to deem any registrant ineligible to attend the Event and You acknowledge and agree that EDB reserves the right to cancel Your registration and issue a refund.
It is against EDB policy to share, swap, and/or trade Event badges at any time during the Event, and Attendees in violation of this policy will be asked to immediately leave the Event without refund.
EVENT PERSONAL CONDUCT POLICY
We firmly believe in the value and importance of providing an environment where all EDB event participants feel safe and welcome, regardless of whether they are interacting at an in-person or virtual event.
We expect all event participants to be respectful and contribute to creating a safe, supportive and professional environment. No harassment, offensive, discriminatory, or inappropriate conduct will be tolerated. If You do not comply with this Event Personal Conduct Policy EDB reserves the right to remove You from the event (without a refund), withdraw Your online access, prohibit Your attendance at future EDB events, and/or pursue other means necessary to appropriately address Your failure to comply with the Policy.
If You become aware of or are subjected to any form of inappropriate conduct in connection with the Event, or would like to express your concerns, please contact events@enterprisedb.com.
ONSITE POLICY
While onsite, You agree to comply with all laws and rules with regard to public health including social distancing protocols and face mask requirements set forth by the federal, state and local government in addition to those set by Event Venue and the Event. You acknowledge the health risks associated with the novel coronavirus (COVID-19) outbreak, and the risk of exposure or infection by COVID-19.
NEITHER EDB, THE EVENT VENUE, THE EVENT ORGANIZER, OR ANY OF THEIR RESPECTIVE PARENTS, AFFILIATES, SHAREHOLDERS, EMPLOYEES, AGENTS, OFFICERS, DIRECTORS, SUCCESSORS, OR ASSIGNS WILL BE LIABLE FOR ANY INJURY OR ILLNESS, HOWEVER CAUSED, ARISING FROM, OR IN ANY WAY RELATED TO COVID-19 IN CONNECTION WITH THE EVENT.
EDB may exclude you from the Event for safety reasons at EDB’s sole discretion.
You assume any and all risk, whatsoever, related to any EDB event, and release and discharge EDB and their agents from any liability to the fullest extent allowed by the law.
ATTENDEE PROPERTY
To the extent permitted under applicable law, EDB is not liable for any lost or damaged personal possessions You choose to bring to an Event, including any devices used while participating in Event sessions.
CANCELLATION/SUBSTITUTION POLICY
Subject to applicable cancellation policies, We request that attendees cancel one week prior to the Event Start Date as a courtesy to those who are waitlisted. Fees and costs associated with the cancellation of any travel and/or hotel reservations are Your exclusive responsibility. Email all cancellations to: events@enterprisedb.com.
EVENT CANCELLATION
EDB reserves the right at any time to cancel the Event due any circumstances that EDB in its sole and absolute discretion deems would make the Event either non-viable or impractical to provide, including but not limited to low enrollment, events or occurrences relating to natural disasters, threats of terrorism, illegality of the Event or any other similar circumstances or occurrences. If EDB cancels the Event, registrants will be offered a full registration refund. Refunds will be issued via the original payment method used, no later than (30) days after cancellation. Should circumstances arise that result in the postponement of the Event, EDB has the right to either issue a full refund or transfer registration to the same event at the new, future date. EDB will not be liable for any third-party expenses that You may incur, including but not limited to hotel and travel, in connection to any cancellation or postponement of the Event.
